RE:
Request to withdraw order and rescind late fees assessed to Jason M. Decuir for failure to file his Supplemental campaign finance report that was due by February 17, 2010.
Facts:
Jason Decuir was an unsuccessful candidate in the October 20, 2007 election for State Senate, District 14. Mr. Decuir filed his 40-G report listing an outstanding loan deficit of $33,000. Former candidates carrying a negative balance in excess of $2,500 were required to file a 2010 supplemental campaign finance report by February 17, 2010. On August 20, 2010, the Ethics Board issued an Order requiring Mr. Decuir to file the required report and assessed the maximum late fee of $2,000. In addition, the Board imposed a $2,000 penalty to be assessed if the required report was not filed by September 27, 2010. Mr. Decuir did not file this report because the $33,000 deficit was a loan that he had forgiven on December 31, 2008. On June 14, 2012, he filed an amendment to his previous report which listed the forgiven loan of $33,000. Attached to the amended report is an affidavit by Mr. Decuir stating that he did in fact forgive the loan and that his campaign account has been closed.
Law:
La. R.S. 18:1495.4D(3) states that a candidate who is not an elected official shall file supplemental campaign finance reports if his final report for an election shows a deficit or surplus equal to or greater than $2,500.
Recommendations:
Withdraw order and rescind late fees that were assessed for this report.
