RE:
Request that the Board waive the $50 late fee assessed against Jeffery A. Drozda for failure to timely file a Lobbyist Expenditure report and waive the $1200 late fee for failure to time file a Supplemental Registration report.
Facts:
Mr. Drozda filed his lobbyist expenditure report that was due by October 25, 2012, one day late on October 26, 2012. He was assessed a late fee of $50.

Mr. Drozda states that he attempted to complete his online report on October 25, 2012, however, he was having internet issues that he was unaware of. For this reason, he thought his report had been completed and discovered that it was not finalized on October 26, 2012 when he received notice. Mr. Drozda, upon notice, finalized his report on that date. He is requesting leniency as he is fairly new to this process.

Mr. Drozda filed a Supplemental Registration report that was due on November 6, 2012, 24 days late on November 30, 2012. He was assessed a late fee of $1200.

Mr. Drozda claims while Casa de Sue Winery was registered as a client as of November 1, 2012, they would not actually be clients for which he lobbied until January of 2013. He stated that he was unaware of the relevance of the November 1, 2012 start date and the conflict it would bring regarding registration on November 30, 2012.

Law:
La R.S. 24:58D(1) and 49:78D(1) state that any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
Recommendations:
Decline to waive the September 2012 Lobbyist Expenditure Report late fee. Suspend the late fee for the supplemental report based on future compliance.
