RE:
Request that the Board waive the $850 late fee assessed against Jodee Bruyninckx for failure to timely file a lobbyist expenditure report and waive the $1500 late fee assessed for failure to timely file a Supplemental Registration Report.
Facts:
Mrs. Bruyninckx filed her lobbyist expenditure report that was due by October 25, 2012, seventeen days late on November 11, 2012. She was assessed a late fee of $850. Mrs. Bruyninckx states that she relocated to Monroe, LA during this period. She states that they were also in the process of adopting a baby. She states that this, along with no longer receiving e-mails from her LOGA account, caused her to neglect filing her September Expenditure Report. She states that she offers no excuse for her delinquent filing other than the exceptional personal events in her life at this time.
Mrs. Bruyninckx filed her Supplemental Registration Report that was due by September 11, 2012, sixty-two days late on November 12, 2012. She was assessed a late fee of $1500. Mrs. Bruyninckx states that this was done in error and her end date should have been November 12, 2012. She provided a letter from Louisiana Oil and Gas Association (her employer) verifying this.

Law:
La R.S. 24:58D(1), 49:78D(1), and 33:9668D(1) state that any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
Recommendations:
Decline to waive the $850 late fee fee.

Suspend the $1500 late fee based on future compliance.
