In connection with his request for a waiver of the $480 late fee, Dana Bruhnke, states that he had no expenses associated with his October 2, 2010 campaign. He further states that he was unaware he was required to file a report. It was not until he contacted our office regarding some issues regarding his final report, that he was informed about the requirement to file an expenditure report.
At the time that the EDE-P report was filed, La. R.S. 42:1157 provided that the late filer may apply to the Board for a waiver of late fees within thirty days after the mailing of the late fee assessment. Dana C. Bruhnke was assessed a late fee of $480 on November 5, 2010 (see attached documentation). Mr. Bruhnke had until December 6, 2010 to submit a request for a waiver of the assessed late fee. Mr. Bruhnke's waiver request was submitted on December 17, 2012. Thus, Mr. Bruhnke's request for a waiver of the $480 late fee is untimely. Mr. Bruhnke was sent an "appeal" letter dated November 14, 2012 allowing him to appeal the $480 late fee (see attached).

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
