Request that the Board waive the $2,000 campaign finance late fee assessed against Donald Klotz, Jr., a candidate for Judge, 24th JDC, Sec. 2, Div. A, in the March 27, 2010 election, whose Supplemental campaign finance disclosure report was filed 539 days late.
Facts:
In connection with his request for waiver of the $2,000 late fee assessed for the late filing of the Supplemental campaign finance report, Donald Klotz, Jr. states that he ran for office in 2010 as a first time candidate and was unfamiliar with the filing requirements. Besides his inexperience, he had a series of family issues to deal with during and after the campaign. His oldest son exhibited strange behavior and it was determined that he was abusing prescription drugs, and heroine. Mr. Klotz further states that he did receive notice of the need to file the report, however, taking care of his son took priority. He was finally able to electronically file his report after getting instructions from the IT division. Mr. Klotz states that his son is now at a facility in Texas and they are scheduled for a three-day family therapy session the second week of January. The trip will cost them a considerable amount of money, therefore, he ask that the late fee be waived. In addition, the candidate has provided additional information and documentation to support his claim regarding his son's medical treatment and it is attached for review.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.

Recommendations:
Waive the fine.
