Advisory opinion request regarding the propriety of Jefferson Parish government employees receiving gifts from the Jefferson Parish Employees Federal Credit Union.
Facts:
Jefferson Parish Employees Federal Credit Union (JPEFCU) is a local member owned credit union which operates for the benefit of employees of Jefferson Parish and other governmental agencies. JPEFCU occupies space in Jefferson Parish government buildings through several Cooperative Endeavor Agreements with Jefferson Parish. JPEFCU offers boxes of candy to some parish departments which have been helpful to JPEFCU during the year and hosts luncheons for employees named as "ambassadors" or "co-ambassadors" for parish departments. During the luncheons, the honored employees are given a presentation about the credit union and a gift. The latest gift given was a roadside assistance kit with the JPEFCU logo containing things such as jumper cables, screw drivers, batteries, poncho, gloves, and first aid bandages.
Law:
Section 1115A of the Code of Governmental Ethics prohibits a public servant from soliciting or accepting any thing of economic value as a gift or gratuity from a person who has or is seeking to have a contractual or other business or financial relationship with his agency.
Section 1102(22)(a) of the Code of Governmental Ethics defines "thing of economic value" as money or any other thing having economic value, except promotional items having no substantial resale value.
Recommendations:
Adopt the proposed advisory opinion.
