Appearance in connection with a request that the Board waive the $700 and $1,000 campaign finance late fees assessed against Trudy White, a candidate for Judge, 1st Circuit Court of Appeal, in the November 6, 2012 election, whose 10-P and EDE-P campaign finance disclosure reports were filed 7 and 46 days late.
Facts:
In connection with her request for a waiver of the $700 and $1,000 late fees assessed for the late filings of a 10-P and EDE-P campaign finance reports, Trudy White states that her 10-P report was timely submitted by her treasurer, as stated on her receipt of electronic filing, which is attached for review. When she received notice that the report was not timely filed, she contacted the Campaign Finance division and was informed by staff that the data for the report was entered timely, however, her treasurer did not change the date. Her treasurer then resubmitted the report with the correct date. As for the EDE-P report, Ms. White states that because she did not make the runoff, her treasurer filed a 10-G report on November 16, 2012, although the report wasn't due until November 28, 2012. The 10-G report included data that supported that she did not have any election day expenses. Ms. White states that upon receipt of notice from the Campaign Finance division regarding her EDE-P report, her treasurer contacted the office and was informed that even though there were no election day expenses, an EDE-P report was still required. An EDE-P report was then immediately filed. Ms. White is a major level candidate. This is her sixth campaign. She was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.

Recommendations:
Suspend all but $200 of the fine for the 10-P report and decline to waive for the EDE-P.
