RE:
Request that the Board waive the $780 and $180 campaign finance late fees assessed against Carolyn "Gee" George, a candidate for East Baton Rouge Parish Metro Council, District 6, in the November 6, 2012 election, whose 30-P and EDE-P campaign finance disclosure reports were filed 13 and 3 days late.
Facts:
In connection with his request for a waiver of the $780 and $180 late fees assessed for the late filings of a 30-P and EDE-P campaign finance reports, Michael Charles Guy, on behalf of the candidate states that as a first time candidate, Ms. George was unfamiliar with the procedure for the filing of campaign reports. However, she made a good faith effort in attempting to abide by the rules for the submission of the reports.


La. R.S. 42:1157 provides that the late filer may apply to the Board for a waiver of the late fees within twenty days after the mailing of the late fee assessment. Carolyn George was assessed late fees of $780 and $180 on November 8, 2012 and December 13, 2012. According to USPS, Ms. George received her $780 late fee assessment on November 14, 2012 and her $180 late fee assessment on December 20, 2012.(see attached documentation) A request for a good cause waiver must have been submitted by December 4, 2012 and January 9, 2013. Ms. George's waiver request for both late fees was submitted on January 8, 2013. Ms. George's request for a waiver of the $780 late fee is untimely. However, the request for a waiver of the $180 late fee is timely.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $200 for the 30-P and decline to waive for the EDE-P.
