RE:
Request that the Board waive the $1,000 and $400 campaign finance late fees assessed against Archie L. Martin, Jr., a candidate for Mayor of the Village of Anacoco, in the November 6, 2012 election, whose 30-P and EDE-P campaign finance disclosure reports were filed 55 and 27 days late.
Facts:
In connection with his request for a waiver of the $1,000 and $400 late fees assessed for the late filings of a 30-P and EDE-P campaign finance reports, Archie L. Martin, Jr. states that during the time the reports were due, he was suffering along with his wife from a severe case of the flu (see attached medical documentation and additional information correspondence). Mr. Martin further states that he received two contributions to his campaign, one for $300 and the other for $400. Mr. Martin maintains that he believed the amount of the contributions were below the amount that required filing a report. Mr. Martin states that the late fees would create a real hardship and therefore ask that the late fees be waived. Mr. Martin is an any other level candidate. This is his third campaign. He was an unsuccessful candidate.

As an any other level candidate, Mr. Martin became required to file a report on August 8, 2012, when he received the $300 contribution; he received the $400 contribution on October 1, 2012. This activity fell within the reporting period for the 30-P report. Also, Mr. Martin received a copy of the qualifying packet for any other level candidates, which provided information regarding the requirement for reporting contributions in excess of $200 in the aggregate during the aggregating period; as evidenced by his signature on the acknowledgment of receipt of information form (see attached documentation).

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

18:1484.(2)(b). Each candidate for any other public office shall file reports of receipt of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $100 on the 30-P report and decline to waive for the EDE-P report.
