RE:
Request that the Board waive the $3,000 and $800 campaign finance late fees assessed against LA Home Builders Association, a political action committee, whose 90-P and 10-P campaign finance disclosure reports were filed 86 and 4 days late.
Facts:
In connection with her request for a waiver of the $3,000 and $800 late fees assessed for the late filings of a 90-P and 10-P campaign finance reports, Jeannie A. Dodd, on behalf of the committee, states that she has had difficulty with filing proper reports. The committee was previously fined in 2012 for not timely filing a 10-G report regarding contributions made in 2011. Ms. Dodd maintains that she filed a 30-P report for a contribution received in 2012, believing that she was filing the proper report timely. However, she received a call from the Campaign Finance division, informing her of the committee's requirement to file a 90-P report. A report was immediately filed.

The committee's 30-P report reflected a $5,000 expenditure on July 24, 2012 to Erich Ponti, a candidate for Public Service Commissioner in the November 2012 election. This expenditure indicated that the committee was required to file a 90-P report. Staff sent the committee a letter dated October 19, 2012, requesting that a 90-P report be filed(see attached documentation).

A 10-G report filed 1 day late, in connection with the October 20, 2007 election. The late fee assessed for the late filing of the report has been paid. A 180-P and 90-P reports each filed 8 days late, in connection with the October 22, 2011 election. A 10-G report filed 411 days late, in connection with the February 19, 2011 election, and a 10-G report filed 411 days late, in connection with the April 2, 2011 election. The Board Docket No. 2011-1116, agreed to suspend all but $500 of the $1,600 assessed for the late filing of the 180-P report filed 8 days late conditioned upon future compliance. The $1,100 late fee was reassessed as a result of recent late filing of the 10-G report in connection with the February 19, 2011 election. The $1,250, $500, and reassessed $1,100 late fees are presently pending before the EAB.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
