RE:
Request that the Board waive the $400 campaign finance late fee assessed against Robert Danos, a candidate for Greater Lafourche Port Commission, Div. I, in the November 6, 2012 election, whose 10-P campaign finance disclosure report was filed 29 days late.
Facts:
In connection with his request for a waiver of the $400 late fee assessed for the late filing of a 10-P campaign finance report, Robert Danos states that he lost his five year granddaughter to viral pneumonia after a seven week illness at Children's Hospital in New Orleans. He further states that filing a report was the last thing on his mind. It was not a deliberate act on his part not to file a report. Mr. Danos further states that he believed that he wasn't required to file a report, if he didn't spend any money. This is his first campaign. Mr. Danos is an any other level candidate. He was an unsuccessful candidate.

As an any other level candidate, Mr. Danos became required to file a report on October 12, 2012, when he received a $750 contribution. This activity fell within the reporting period for the 10-P report. Staff sent correspondence dated November 14, 2012 to Mr. Danos informing him of his requirement to file a 10-P report and amend his 10-G report (see attached). Also, Mr. Danos received a copy of the qualifying packet for any other level candidates, which provided information regarding the requirement for reporting contributions in excess of $200 in the aggregate during the aggregating period; as evidenced by his signature on the acknowledgment of receipt of information form (see attached documentation). Also, staff requested documentation from the candidate, supporting his claim regarding the loss of his granddaughter and it is attached.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of receipt of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Waive the fine.
