Advisory Opinion request from Lt. Colonel Jeff Maynes of Wildlife and Fisheries regarding potential secondary employment with ECS, Inc.
Facts:
He has withdrawn his Opinion Request as he was not selected for the position.

Comments:
Lt. Colonel Jeff Mayne is The Assistant Chief of Law Enforcement for the Louisiana Department of Wildlife and Fisheries was seeking secondary employment with a company named ECS, Inc.

ECS, Inc. is an employment contractor for the U.S. Department of Commerce, National Oceanic and Atmospheric Administration. (NOAA)
The position that he applied for is a Policy Analyst Position for which ECS, Inc. He would work from his residence during off duty time. he is not aware of ECS, Inc having any working relationship with the Louisiana Department of Wildlife and Fisheries.

NOAA does have many projects connected with the agency including a Joint Enforcement Agreement were Wildlife and Fisheries Law Enforcement Division does receive federal dollars for our staff to enforce federal fishery regulations. The department does also have other grants from NOAA and other working relations as a federal partner in fisheries management.

Law:
1111C(1)(a) provides that no public servant shall receive any thing of economic value for any service, the subject matter of which is substantially devoted to the responsibilities, programs, or operations of the agency of the public servant has participated.



Recommendations:
Allow the withdrawal of the request.
