| Advisory opinion regarding whether Kenneth Squires, commissioner for the Iberia Parish Airport Authority, may bid on an airport hangar owned by Iberia Parish Airport and purchase gas from the Airport. |

Kenneth Squires states that he is the only Commissioner who owns and flies both airplanes and helicopters for a living. He would like to rent one of the 13 new 40' x 42' single plane hangars on the Jeanerette airport. These hangars are owned by Iberia Parish and are newly constructed. Months ago, the IPAA asked for an AG opinion on rental pricing these hangars and after great deliberation between the Authority with the Louisiana Attorney General's office the AG recommends the rent pricing method to be; a minimum appraisal be undertaken and held to, followed by a 28 days of local newspaper advertising in which "bids" are then solicited with the appraisal as the minimum base bid.
Mr. Squires would like to keep his original hangar, (he purchased the simplistic structure from an individual and rents the ground under it each year from IPAA), and also to rent one of the new ones that have a nice concrete taxiway from IPAA, assuming his bidding is successful. He would also like to be cleared to buy airplane gasoline from the IPAA owned automated credit card pump and tank at the Jeanerette airport.
Mr. Squires is a crop-duster. He uses helicopters off a 5 acre site he owns on Highway 90 at Jeanerette. His airplane activity at the Jeanerette airport amounts to company transportation and or recreation and the reconstruction of damaged airplanes for my own use.He does not offer any commercial services to the public at the Jeanerette airport.

Section 1113B of the Code prohibits an appointed member of a board or commission from entering into or being in any way interested in a transaction that is under the supervision or jurisdiction of the board. However, Section 1123(20) provides that an airport authority member in any parish having a population of less than two hundred thousand persons may use any of the services available at the airport over which he exercises jurisdiction, provided the services are available to the member subject to the same terms, conditions, and availability as to any other member of the public.
