Advisory opinion request regarding whether the son of the Fire Administrator for Tangipahoa Parish Rural Fire District #2 may be employed as a part-time employee of the Independence Volunteer Fire Department.
Facts:
The Independence Volunteer Fire Department contracts with Tangipahoa Parish Rural Fire District #2 to provide fire and emergency response for the town of Independence and its rural areas. Dennis Crocker was the previous Chief of the Independence Volunteer Fire Department until December 15, 2012. Mr. Crocker took a new position with Tangipahoa Parish Rural Fire District #2 as the Fire Administrator who oversees financial matters and has input on the daily and fire ground operations of all fire departments under Tangipahoa Parish Rural Fire District #2. The Independence Volunteer Fire Department is considering hiring Andrew Crocker, the son of Dennis Crocker, to work as a part-time employee.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
