Advisory opinion request regarding whether Gentry Major can be employed by Veolia Water when his mother, Barbara Major, works for The Regional Transit Authority.
Facts:
Mr. Haley the general counsel for Veolia Water has requested an opinion regarding whether Gentry Major can be employed by Veolia Water. Mr. Major was prohibited by Section 1113 of the Code from seeking employment with Veolia Transportation Services, Inc. based on his mothers position as a Commissioner with the RTA. Veolia Transportation Services, Inc. has a contract with the RTA. Mr. Haley has stated that Veolia Water and Veolia Transportation are two separate entities. The Regional Transit Authority does not have any relationship with Veolia Water contractual or otherwise.
Comments:
In Opinion 2011-691 the Ethics Board prohibited Mr. Major's employment with Veolia Transportation Services, Inc. based on his mother, Barbra Major's employment on the Board of Commissioners for the Regional Transit Authority (RTA). The RTA has a contract with Veolia Transportation Services, Inc. The Ethics Board found that Section 1113B of the Code prevented Mr. Major's employment with Veolia Transportation Services.



Law:
La. R.S. 42:1113B prohibits an appointed member of any board or commission, a member of his immediate family, or legal entity which he has a substantial economic interest from biding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.

Recommendations:
Adopt the proposed advisory opinion.
