Advisory opinion request from Ms. Judith Bell a former employee of the Department of Motor Vehicles regarding any post employment restrictions that would prevent her from opening a driving school.
Facts:
Ms. Bell worked for the State of Louisiana for over 19 years as a Motor Vehicle Compliance Analyst. She retired in October of 2011. Ms. Bell would like to file an application to open a driving school. Part of her job with the Department was to administer the Road Test. However, she would like to note that she did not teach anyone how to drive when administering the driving test. She has completed the training courses for new time driving school applicants. She has purchased the required insurance and is currently renting a building for her driving school.

Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render any service which such former employee rendered to the agency during his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
