Advisory opinion request regarding Ms. Tammy Conner an employee of the Department of Public Safety & Corrections regarding any post employment restrictions that would prevent her from opening a driving school.
Facts:
Tammy Conner is working a temporary assignment through Westaff for DPSC The assignment began 12/26/2012 and will end 3/8/2013. While at DPSC her work consisted of entering juvenile payment of supervision fees into computer system for tracking. The fees occurred from juveniles who were placed in a juvenile facility for misbehavior and the court ordered them to be put on probation and pay supervision fees. She is assigned to the Finance and Management Section. She has never worked for DPSC before and does not intend to work for the Department in the future. She will focus on the opening of her new driving school. The driving school will be open to anyone who plans on obtaining their driving license for the first time. She will prepare students with driving license curriculum information for the test at Department Motor Vehicle and driving skills test.

The only interaction between the driving school and the Department of Motor Vehicles is an application and issuance of license by the Department of Motor Vehicles necessary to operate a driving school.

Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render any service which such former employee rendered to the agency during his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
