Advisory opinion regarding whether Dr. Rebekah Gee may become the Louisiana Medicaid Medical Director for the Department of Health and Hospitals, Bureau of Health Services Financing, while employed with the LSU School of Public Health.
Facts:
Dr. Rebekah Gee is a salaried employee with the LSU School of Public Health, for which she performs clinical duties and has some teaching responsibilities. LSU as well as Dr. Gee is a Medicaid provider. Dr. Gee's compensation from LSU is in no way influenced or determined by coding, reimbursement, or the medical decisions or treatment she renders as a physician for LSU. Dr. Gee is not involved in any submission of coding or billing for LSU which would lead to Medicaid reimbursement. Dr. Gee's contact with Medicaid patients will take the form of medical calls she will undertake in a supervisory capacity overseeing resident trainees once day per month. As a supervisor, Dr. Gee will not typically make clinical decisions but will oversee clinical decisions of obstetricians in training while contributing to the education of residents and maintenance of patient safety. De. Gee will not be reimbursed with DHH or Medicaid funds.

Dr. Gee seeks to become the Louisiana Medicaid Director with DHH, Bureau of Health Services Financing. Dr. Gee will perform highly advanced consultative work and serve as an authoritative resource for the Medicaid Director and the Bureau of Health Services Financing. Dr. Gee will not make any conclusive policy or reimbursement decisions, but will be advisory only.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.

Recommendations:
Adopt proposed advisory opinion.
