| Advisory opinion request regarding whether Rhonda Bedgood, a Right of Way agent with DOTD may provide contract services after she retires from DOTD. |

Rhonda Bedgood is currently a Right of Way Agent with DOTD and will be retiring as of June 23, 2013. Her current job duties include auditing and overseeing local public agency right of way acquisitions for off-system local federal aid transportation projects. After she retires, she would like to contract with local city and parish governments to perform their right of way acquisition activities which can include off-system federal aid projects. These activities will not include projects that she participated in while employed with DOTD. She would also like to provide contract services to DOTD for abstract work for property ownership. The title work will be prepared at the onset of a project so she will not perform abstract work on any projects that she has overseen during her employment with DOTD. However, she would render the same type of services to DOTD that she performed while employed with DOTD.

Section 1121B(1) of the Code of Ethics states that no former public employee shall, for a period of two years following the termination of his public employment assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he is formerly employed.
Section 1121B(1) also states that a former public employee, for a period of two years following the termination of his public employment may not render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
