RE:
Request that the Board waive the $200, $40, and $320 campaign finance late fees assessed against Harry Lege, a candidate for Vermilion Parish Police Jury, District 9, in the October 22, 2011 election, whose Special, EDE-P and 10-G campaign finance disclosure reports were filed 5, 1, and 8 day(s) late.
Facts:
In connection with his request for a waiver of the $200, $40 and $320 late fees assessed for the late filings of a Special, EDE-P and 10-G campaign finance reports, Harry Lege, states that during his campaign, he had a heart attack. He left the responsibility of filing his reports with his campaign manager and his campaign manager filed the reports late. Mr. Lege further states that he is on social security and has no other income due to losing his 401K when the market fell. Mr. Lege is an "any other" level candidate. This is his first campaign. He was an unsuccessful candidate.

In January of 2013, staff requested medical documentation to support Mr. Lege's medical claims. No information has been received. In addition, at the time that the late fees were assessed, La. R.S. 42:1157 provided that the late filer may apply to the Board for a waiver of late fees within thirty days from the mailing of the late fee assessment. Mr. Lege was assessed the $200, $40 and $320 late fees on January 23, 2012. Mr. Lege received the late fee assessment on January 24, 2012. Mr. Lege's waiver request was submitted on January 18, 2013. Therefore, the waiver request for the $200, $40 and $320
late fees is untimely.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $100 for the 10-G report and decline to waive the assessed late fees for the Special and EDE-P report.
