Request that the Board waive the $600 campaign finance late fee assessed against Myron K. Lawson, a candidate for Alexandria City Council, in the September 30, 2006 election, whose Supplemental campaign finance disclosure report was filed 694 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a 2010 calendar year Supplemental campaign finance report, Myron K. Lawson, states that he was under the impression that he had filed a final report for the 2006 election and was finished with that election once he filed a Supplemental Report for the 2011 calendar year. Mr. Lawson states that he believes that he should not be fined for submitting an omitted report (supplemental for the 2010 calendar year) after the final report was submitted. He believes that any late fees should be forgiven since he was assessed a late fee for the late filing of the 2011 calendar year supplemental report.

18:1495D(1)(a) provides that if the final report of a successful candidate shows a deficit or surplus, the candidate must file a Supplemental report. Mr. Lawson, in connection with the 2006 election, filed a Supplemental report for the year of 2009 on February 22, 2010, which showed an outstanding loan in the amount of $3,000, necessitating the filing of a Supplemental report by for the year of 2010 by February 15, 2011.

Charges were filed for Mr. Lawson's failure to file his 2010 calendar year Supplemental report in connection with the 2006 election. It was not until one day before a hearing before the EAB (Ethics Adjudicatory Board) that Mr. Lawson filed the required report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
