Request that the Board waive the $60 and $180 campaign finance late fees assessed against James E. Slaughter, Jr., a candidate for East Baton Rouge Parish Metro City Council, District 2, in the November 6, 2012 election, whose 10-P and EDE-P campaign finance disclosure reports were filed 1 and 3 day(s) late.
Facts:
In connection with his request for a waiver of the $60 and $180 late fees assessed for the late filings of a 10-P and EDE-P campaign finance reports, James E. Slaughter, Jr., states that he has been unemployed for the last year and half. The reason he ran for office was to hopefully obtain a job with the city. He currently has financial arrangements with the State and IRS, and he has to pay a $10,000 student loan. Mr. Slaughter further states that he believes he should be granted a waiver of the late fees because the Board previously agreed to reduce Commissioner James Donelon's late fee by over 90%, and payment of the assessed late fees would present a financial burden. Mr. Slaughter is a district level candidate. This is his fifth campaign. He was an unsuccessful candidate.
Mr. Slaughter makes reference of the Board reducing Commissioner James Donelon's late fee. In docket matter no. 2012-1589, the Board, at its October 19, 2012 meeting, with the recusal of Terry Backhaus and Bob McAnelly, agreed to suspend all but $1,000 of a $17,500 late fee assessed against Commissioner Donelon for filing his 2011 Tier 1 annual personal financial disclosure report 36 days late.

La. R.S. 42:1157 provides that the late filer may apply to the Board for a waiver of late fees within twenty days after the receipt of the late fee assessment. Mr. Slaughter was assessed the $60 and $180 late fees on December 13, 2012. Mr. Slaughter received the late fee assessment on December 18, 2012, and a request for a good cause waiver must have been submitted by January 7, 2013 (see attached documentation). Mr. Slaughter's waiver request was submitted on January 29, 2013. Therefore, the waiver request for the $60 and $180 late fees is untimely.

30-P and 10-P campaign finance reports each filed 1 day late, in connection with the October 20, 2007 election, and a 30-P campaign finance report filed 2 days late, in connection with the November 6, 2012 election. The late fees assessed for the late filings of the reports have been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
