Advisory opinion regarding whether a newly hired Assistant District Attorney for St. Landry Parish, David Pitre, may lease office space from the retired Assistant District Attorney for St. Landry Parish who is also his mother-in-law.
Facts:
Earl Taylor, District Attorney of the 27 Judicial District, is hiring a new Assistant District Attorney, David Pitre, who will be the assigned representative and legal adviser to St. Landry Parish Government, and whose duties will include the handling of civil matters for that body. His responsibilities will be identical to those of his ADA- mother-in -law, Andrea West, who is retiring. Mr. Pitre would like to enter into a lease agreement with his mother-in-law for the office she held as an ADA. The potential lease agreement would be between the new ADA and the retired ADA mother -in -law, after her retirement from this office.
Law:
Section 1113 prohibits a public servant from entering into a transaction that is under the supervision of the agency of the public servant.
Recommendations:
Adopt the proposed advisory opinion.
