Request that the Board waive the $280 campaign finance late fee assessed against Natalie L. Robin, a candidate for Iberia City Council, in the November 6, 2012 election, whose 40-G campaign finance disclosure report was filed 7 days late.
Facts:
In connection with her request for a waiver of the $280 late fee assessed for the late filing of a 40-G campaign finance report, Natalie L. Robin states that she believed that since she had not collected or spent additional money, she was not required to file a report. When she received notice from the Campaign Finance division, she immediately filed a report. As she was preparing her report, she realized that she had in fact spent additional monies.

Ms. Robin maintains that she was contacted at the last minute by a community organization to participate as Mrs. Claus in the city's annual Christmas parade. She saw the opportunity as a way to promote her campaign, since she was approaching the end of the run-off election. She used the monies for costume rental, candy and participation fees. Eleven days later, she was victorious in her race for City Council. Ms. Robin further states that it was a complete slip of the mind that she did not report the expenditures. Ms. Robin is an any other level candidate. This is her first election.
In addition, as an any other level candidate, Ms. Robin became required to file reports on August 12, 2012, when she received a contribution in the amount of $300.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $100 based on future compliance.
