Reconsideration of a request that the Board waive the $1,400 campaign finance late fee assessed against Shreveport Committee on Political Education, a political action committee, whose EDE-G campaign finance disclosure report was filed 7 days late.
Facts:
In connection with her request for reconsideration of a waiver of the $1,400 late fee assessed for the late filing of an EDE-G campaign finance report, Patricia Anderson, Treasurer on behalf of the committee states that she was unaware that the report had not been filed. She discovered that the report had not been filed when she looked through some mail and found where Roosevelt Smalley, chairman for the committee, had requested a waiver of the late fee. Ms. Anderson states that Mr. Smalley entered the hospital on May 8, 2012 and died on May 28, 2012.

The Board first considered the request for a waiver at its May 18, 2012 meeting, and the Board declined to waive the late fee. Also, as previously stated, the committee, in addition to the $1,400 late fee, has other outstanding late fees totaling $4,100.

An EDE-P report filed 126 days late, and a 10-G report filed 104 days late in connection with the October 4, 2003 election. An EDE-P report filed 27 days late, and a 10-G report filed 7 days late in connection with the September 30, 2006 election. The late fees and reassessed late fees totaled $7,400. The Board in 2007-169 approved a payment plan of $300 a month. To date, the committee has paid $4,300 of the late fees. The amount of $4,100 remains outstanding.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
