RE:
Request that the Board waive the $920 campaign finance late fee assessed against Walter J. Leger, III, a person who supported a proposition, in the November 6, 2012 election, whose 40-days after the election report was filed 23 days late.
Facts:
In connection with his request for a waiver of the $920 late fee assessed for the late filing of a 40-days after the election report, Walter J. Leger, III, states that he was not a candidate in the November 6, 2012 election. He states that his only involvement was a contribution of $500 to assist with the production of a mailer in support of an Amendment to the City of New Orleans Home Rule Charter. The first report was timely filed on October 31, 2012, and disclosed all pertinent information related to the expenditure. The second filing was due on December 17th, and regrettably was not timely filed.

Mr. Leger further states that he was married on December 8, 2012 and out of town on his honeymoon until December 20, 2012. When he was alerted on January 9, 2013 that the 40 days after the election report was due, he immediately filed the report. As an "other person" participating in a proposition election, Mr. Leger was required to file reports when his contribution was over $200. On October 29, 2012, Mr. Leger contributed $500 from his campaign account and purchased mailouts to support a proposition. This activity was reported on the 48 hour Special report filed by Mr. Leger on October 31, 2012 as an in-kind contribution.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $100 based on future compliance.
