RE:
Advisory opinion request regarding the propriety of University of New Orleans (UNO) campus organizations accepting donated items of substantial value from private companies that have a business relationship with UNO and conducting events wherein employees of UNO may win those donated items.
Facts:
UNO conducts business with several private companies that are interested in donating items of substantial value to organizations on campus with whom they have no official dealings including the Staff Council and Faculty Senate. The donated items would then be used by those campus organizations to conduct random raffles, door prizes, or employee auctions with the proceeds going to the organizations. The employees of UNO may participate in the raffles or auctions and possibly win the donated items.
Law:
Section 1115A of the Code of Governmental Ethics prohibits a public servant from soliciting or accepting any thing of economic value as a gift or gratuity from a person who has or is seeking to have a contractual or other business or financial relationship with his agency.
Recommendations:
Adopt the proposed advisory opinion.
