Ms. Vezinot served as the designee of Lt. Governor Mitch Landrieu on the Commerce and Industry Board. In November 2010, with the change of administration, Lt. Governor Jay Dardenne appointed a new designee to serve for him on the Commerce and Industry Board. Due to these changes, Ms. Vezinot inadvertently filed her report late. Ms. Vezinot asks for leneincy due to her inexperience and misinformation regarding the procedures for filing the 2010 pfd. Ms. Vezinot also states the fine imposes a financial hardship.



Comments:
The waiver request is untimely.

Julie Vezinot received her late fee order on February 13, 2012. She was required to file a waiver request or remit payment by March 8, 2012. On January 18, 2013, Ms. Vezinot received a demand letter requesting payment or advising that a lawsuit would be filed for collection. In response, Ms. Vezinot submitted this request for a waiver citing financial hardship. No supporting documentation was submitted.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than fourteen (14) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
