RE:
Request that the Board waive the $600 campaign finance late fee assessed against Richard Wayne "Rick" Foster, a candidate for Coroner of Tangipahoa Parish, in the October 22, 2011 election, whose Supplemental campaign finance disclosure reportwas filed 10 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a Supplemental campaign finance report, Richard Wayne "Rick" Foster, states that he did receive a reminder notice to file his report. He had every intention to file his report the beginning of February. Unfortunately, he misplaced his letter reminding him to file the report. It was not until the Friday, the 22nd of February, that he found the letter. He immediately contacted the Campaign Finance division to address the problem. He left a message with Angela Newsome, and later that day, Ms. Newsome returned his called and informed him that he needed to electronically file his report.
Mr. Foster maintains that on that day he attempted several times to send his report electronically but he was unsuccessful. It was not until Monday, after three attempts and with the help of Gene Dawson of the IT division, that he successfully filed his report. Mr. Foster ask that the Board forgives the last three days that he was unable to file because of the weekend. He also is asking for some leniency with the seven days that he was late because of misplacing his letter, and also for the fact that he has not touched the money in his account for a multiple of years. Mr. Foster is a district level candidate. This is his fourth campaign. He was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
