RE:
Advisory opinion regarding what can be done to protect the job of the spouse of Carl Contranchis, former Clerk of Court for the City of Gretna, while he campaigns for a position on the Gretna City Council.
Facts:
Carl Contranchis states that when he decided to run for Gretna City Councilman his wife received the policy regarding campaigning. He states that his wife was informed that she could not assist with his campaign. He states that their yard bears campaign signs and that the position of the signs in the yard may indicate that the spouse is assisting with the campaign. His wife is employed as a clerk/receptionist for the Jefferson Parish Council. Mr. Contranchis suggests that his wife can move to his father's home until the campaign is over.
Law:
La.R.S. 18:1505.2I(5) provides that no candidate or principal or any subsidiary political committee may use a contribution, loan, or transfer of funds received by such candidate or committee to make any payment or expenditure to any immediate family member of the candidate.
