Advisory opinion regarding the post employment restrictions applicable to Ellroy James, a former Attorney for the Louisiana Department of Revenue (LDR).
Facts:
Mr. James was employed by the LDR from February 2007 through August 2012. He was employed in the LDR Legal Division, Office of Legal Affairs. He represented the LDR in litigation efforts involving taxpayers that owed corporate income tax and/or franchise tax. Mr. James has also represented the LDR against a few individual taxpayers with outstanding tax liabilities. Mr. James never served as a section chief or agency head for the LDR.

Law:
La. R.S. 42:1121B(1) No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment render any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis regardless of the parties to the contract to for or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
