Advisory opinion regarding whether State Representative Dalton W. Honore may serve on the Southern University System Foundation (Foundation) Board while a member of State House of Representatives.
Facts:
The Foundation is the philanthropy arm of the university. The primary function of the Southern University System Foundation is to support the activities of the Southern University System. The Foundation is private, non-profit organization with a separate board and structure from the university. Private citizens created the Foundation in 1968 to expand the philanthropy mission and goals of Southern University.

The Southern University System Foundation Board of Directors provides governance of the organization, and assists the staff of the university in raising external funds for organization, which ultimately benefits the university and the students. Board members are not compensated. According to Rep. Honore's advisory opinion request, the Foundation, or a representative of the organization would never need to appear before the House of Representatives in any matter. Further, as a member of the House of Representatives, Rep. Honore will never be in a position to affect the Southern University Foundation economically.

Law:
Section 1113C of the Code states that no legislator shall enter into or be in any way interested in any contract, subcontract, or other transaction involving the legislator's agency.


Section 1111E of the Code states that no public servant, and no legal entity of which the public servant is an officer, director, trustee, partner, or employee shall receive or agree to receive any thing of economic value for assisting a person in a transaction, or in an appearance in connection with a transaction , with the agency of such public servant.

Recommendations:
Adopt proposed advisory opinion.
