Vickie Briscoe is the Clerk for the Town of Basile. She also serves on the LA Municipal Gas Authority, which is the position that requires her to file annual pfds. Ms. Briscoe received a notice of delinquency on March 24, 2011. Ms. Briscoe did not think she needed to file since the clerk position is appointed, not elected. However, it was her board position that requires her to file. She finally filed the report on January 4, 2012.
Ms. Briscoe appeared at the March 2013 meeting. She now requests reconsideration of the Board's denial of her waiver request. She has submitted additional information regarding this matter, including that she has resigned from the LA Municipal Gas Authority. She has also submitted information documenting the decline of her husband's health beginning in 2009 leading to his committment to a nursing facility in early 2012. He has suffered from progressive supranuclear palsy, which is a rare disease that falls under the umbrella of dementia. As his sole caretaker and the loss of his income, Ms. Briscoe has been focused on her husband. She states even her job performance falter. Ms. Briscoe states she cannot afford this late fee. She has submitted medical documentation and bank information.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than fourteen (14) business days after receipt of the notice of delinquency. La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
