Mr. Byron Hines has requested an advisory opinion regarding whether the Ethics code would prohibit him from promoting Linda Pullit to the Director of Nursing (DON)position at the Louisiana Northwest War Veterans Home (Home) while her sister Wanda Harris is employed at the Home. Mr. Hines is the Administrator of the Home, as the administrator he is the appointing authority for Home in Bossier City Louisiana.
The Home is a long term care nursing home for veterans operated by the Louisiana Department of Veterans Affairs The current DON will be leaving in the next few months. Ms. Linda Pullit is potential candidate for the DON position. She is a Registered Nurse (RN) on staff whose sister also works at the facility as an RN. Ms. Pullit has been on staff since September 20,2010 and her sister Wanda Harris has been employed since February 21, 2011.
Mr. Hines has stated that if Ms. Pullit is selected he will assume all administrative duties over Ms. Harris to prevent any conflict. He has stated that he would conduct all evaluations, handle all paperwork associated with Ms. Harris and issue any discipline if necessary.

La. R.S. 42:1119A. no member of the immediate family of an agency head shall be employed by his agency.
La. R.S. 42:1119C.(2) The provisions of this Chapter shall not prohibit the continues employment of any public employee nor shall it be construed to hinder or alter, or in any way affect normal promotional advancements for such public employees where a member of the public employees' immediate family becomes an agency head of such public employees agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employees immediate family becoming the agency head.
