Waiver request submitted by Floyd Marshall, Sr., a member of the St. James Parish Hospital Service District, regarding a $250 late fee assessed for filing his 2013 Hospital Service District Disclosure 5 days late.
Facts:
Mr. Marshall states that the disclosure would have been completed timely except that the board's January meeting was cancelled. Further, the hospital had trouble getting in touch with him as he was in and out of the hospital for health reasons. The staff finally reached him and he drove to the hospital to sign it on February 1st, but did not get filed until the 4th due to a weekend in between.

Law:
La. R.S. 42:1119B(2)(b)(i) provides any hospital service district with a population of 100,000 or less or a hospital public trust authority located in such district may enter into an initial recruiting contract with or employ as a health care provider, a licensed physician, a registered nurse or an allied health professional who is a member of the immediate family of any district board, authority, or parish governing authority member or of the chief executive of the district or authority provided that such family member is the only qualified applicant who has applied for the position after it has been advertised for at least 30 days in the official journal of the parish and is all newspapers of general circulation in the parish where the hospital is located.
La. R.S. 42:1119B(2)(b)(ii) provides that no later than January thirtieth of each year, any chief executive and any member of a board of a hospital service district or hospital public trust authority whose immediate family member enters into an initial recruiting contract with or is employed by the hospital service district or hospital public trust authority shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed $1,500.

Recommendations:
Based on the waiver guidelines, waive the late fee.
