Request that the Board waive the $600 campaign finance late fee assessed against Jerry Denton, a candidate for Marshall, City Court, City of Denham Springs, in the October 4, 2008 election, whose Supplemental campaign finance disclosure report for the 2012 reporting period was filed 17 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a Supplemental campaign finance report, Jerry Denton, states that he walked up and submitted in good faith the Supplemental report in person, and has a "date stamped" copy of the report.

He states that at no point during his visit to the office of the Board of Ethics did anyone inform him that the report was required to be electronically filed. He was informed days later that the report must be submitted online. Upon receipt of notice, he applied for a password to use the LEADERS software and when he received the password, he filed his report. Mr. Denton is a district level candidate. This is his third campaign. He was a successful candidate.
The law changed in January 2012 requiring all District and Major office candidates to file campaign finance reports electronically.

An EDE-P, 10-P, and 10-G filed 120, 140, and 107 days late, in connection with the October 4, 2008 election. In Board Docket No. 2009-200, the Board at its April 29, 2009 meeting agreed to waive the $2,000 and $2,000 late fees assessed for the 10-P and 10-G reports. The $600 late fee for the EDE-P report was declined, and it has been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
