In connection with his request for a waiver of the $600 late fee assessed for the late filing of an EDE-P campaign finance report, Claude "Curtis" Hodge, Jr., states that he received a letter stating that he still owes $600 in late fees regarding failure to submit a campaign finance report for the October 22, 2011 election. He further states that he received a letter from our office notifying him that the file regarding the EDE-P report had been closed because he properly filed his EDE-P report. Mr. Hodge is a district level candidate. This is his first campaign. He was an unsuccessful candidate.
Mr. Hodge's reference to a letter stating that his file would be closed because he filed his EDE-P report was in connection with the late filing of the EDE-P report and the assessment of late fees. The letter informed Mr. Hodge that the file was being closed because he had filed the required report and late fees had been assessed as a result of the late filing of the EDE-P report.
A late fee assessment letter was sent to Mr. Hodge via certified mail. The letter was received by Tyler Hodge on July 9, 2012.
At the time of the assessment of the $600 late fee, La. R.S. 42:1157 provided that the late filer may apply to the Board for a waiver of late fees within thirty days from the mailing of the late fee assessment. The late fee assessment was received on July 9, 2012, and a request for a good cause waiver should have been submitted by August 9, 2012.
Claude "Curtis" Hodge, Jr. waiver request was submitted on March 28, 2013. Therefore, the waiver request for the $600 late fee is untimely. Since Mr. Hodge failed to pay the assessed late fee, a demand letter was sent demanding payment of the late fee.

In Board Docket No. 2011-1578 and 2012-737, the Board suspended the $1,140 late fee assessed for the 30-P report, and in Board Docket No. 2012-737, the Board suspended the $900 and $1,260 late fees assessed for the 10-P and 10-G reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office that receives contributions or loans in excess of twenty-five thousand dollars in the aggregate during the aggregating period or that makes expenditures in excess of twenty-five thousand dollars in the aggregate during the aggregating period shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2010, Act 25 of the 2008 1st Extraordinary Session requires Major and District office level candidates with more than $25,000 in contributions/loans or more than $25,000 in expenditures in connection with a specific election to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
