In connection with his request for a waiver of the $400 late fee assessed for the late filing of a Supplemental campaign finance report, David M. Ditch, states that he was unaware that he was required to file a report. He did not raise nor spent any money during the reporting period. Also he maintained a balance of less than $100 dollars simply to keep the checking account active for the future.
Mr. Ditch further states that after listening to a couple of speakers while attending a police jury convention, he realized that he should probably file a report. He has subsequently closed his checking account, as to not run into this problem again. He states that he is a full time businessman and a part-time public servant trying to give back to the community that has been so good to him. Mr. Ditch is an any other level candidate. This is his second campaign. He was a successful candidate.
Mr. Ditch became required to file reports when he reported receiving over $13,350 in contributions on his 30-P report. Mr. Ditch makes reference that he was unaware of the requirement to file the Supplemental report due February 15, 2013. Campaign Finance records show Mr. Ditch was sent a letter on January 11, 2013, notifiying him of the requirement to file a Supplemental report, and was also notified of discrepancies regarding prior reports that he filed in connection with the October 22, 2011 election. Mr. Ditch was also sent a notice of delinquency on February 21, 2013, and the notice was received on February 22, 2013.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
18:1484.(2)(b) Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
