Advisory opinion request regarding Ms. Kathie Pohlman's employment with the Louisiana State Board of Nursing (LSBN) and potential employment with the Louisiana State Board of Social Work Examiners (LABSWE). |

Ms. Pohlman is employed by the Louisiana State Board of Nursing (LSBN) as a Program Manager for the Recovery Nurse Program. Her caseload consists of about two hundred participants. It is her responsibility to ensure nurses are in compliance with the regulation set by the LSBN. While employed with the LSBN, she would like to work part-time with the LABSWE, which is also a state-funded board of about ten participants. She states that she would work part-time and would not use LSBN resources in her capacity as an employee with LABSWE. The services she will be providing are essentially the same services she provides to the LSBN, she would just be doing so on a part-time basis with LABSWE. If not prohibited in doing so, Ms. Pohlman's follow-up question is whether she would be prohibited from using her vacation/personal time to attend Board meetings for several hours during the work week, if requested.

Section 1111C(1)(a) prohibits a public servant from receiving a thing of economic value for a non-public service that is devoted substantially to the responsibilities, programs, and operations of the agency of the public servant and in which the public servant has participated.
