RE:
Advisory opinion request as to the propriety of an employee of the Department of Public Works for Lafayette Consolidated Government being employed by a private company that has previously conducted business with a company that is under contract with his agency.
Facts:
Mitchell Wyble is currently employed by Lafayette Consolidated Government as a City Engineer for the Department of Public Works and has been contacted by S & S Steel, a pre-engineered metal building manufacturer, to review, approve, seal and sign both Wind Load Certificates and metal building fabrication drawings. The work for S & S Steel would be performed outside of his normal work hours for Lafayette Consolidated Government. S & S Steel has occasionally provided metal buildings to general contractors who are under contract with Lafayette Consolidated Government to construct governmental buildings.


S & S Steel dealt directly with the general contractor and not Lafayette Consolidated Government. If S & S Steel were to provide a metal building to Lafayette Consolidated Government through a general contractor in the future, Mr. Wyble would not review or approve any drawings associated with the building. The Department of Public Works, does not have control over which companies are chosen to provide materials to its general contractors.

Law:
La. R.S. 42:1112B(3) of the Code prohibits a public servant from participating in a transaction involving his agency in which any person of which the public servant is an employee has a substantial economic interest.
Recommendations:
Adopt the proposed advisory opinion.
