Advisory opinion request regarding whether members of the Central Louisiana Human Service District may lobby the Louisiana Legislature for more funds.
Facts:
James Sprinkle is a member of the Central Louisiana Human Service District (CLHSD). Mr. Sprinkle states that the CLHSD was created by state government. The monies to run the CLHSD is appropriated to each district according to statute. Due to the economic condition of the state, the funds appropriated are inadequate. Mr. Sprinkle understands that a member cannot individually lobby the legislature for funds; however, Mr. Sprinkle wants to know if the CLHSD as a whole may lobby the legislature for funds.

Law:
La. R.S. 24:56(F) prohibits a state employee in his official capacity or on behalf of his employer from lobbying for or against any matter intended to have the effect of law pending before the legislature or any committee thereof. La. R.S. 24:56(F) does not prohibit the dissemination of factual information relative to any such matter or the use of public meeting rooms or meeting facilities available to all citizens to lobby for or against any such matter.

In BD Docket No. 2004-828, the Board advised that a member of the Louisiana Wildlife and Fisheries Commission was prohibited from lobbying under R.S. 24:56(F). Therefore, it appears the Board has addressed the issue as to whether a member of a board is a state employee subject to the provisions of R.S. 24:56(F).

Recommendations:
Adopt proposed advisory opinion.
