Advisory opinion concerning post-employment restrictions applicable to Tony Tramel, the Director of the Traffic and Transportation Department with the Lafayette City-Parish Government.
Facts:
Tony Tramel plans to retire his position as the Director of the Traffic and Transportation Department with the Lafayette City-Parish Government in March, 2013. The Traffic and Transportation Department was created in 1998 by city-parish council ordinance, but a new ordinance will be considered soon to abolish the department. Mr. Tramel has formed Tony Tramel Consulting, LLC, and anticipates offering transportation engineering services after his retirement.
Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting a person, for compensation, in a transaction or in an appearance in connection with a transaction, involving his former agency or from rendering, on a contractual basis, any service to or for his former agency for a period of two years.

La. R.S. 42:1121B states that no former public employee for a period of two years following the termination of his public employment shall assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
