Advisory opinion from Ms. Maria Leon as to whether companies which provide benefits to City of Kenner employees may provide door prizes and other gifts to city employees at the benefits fair.
Facts:
Kenner's Personnel Department will be hosting a benefits fair for all city employees. The benefits fair will consist of companies which provide benefits to city employees including, but not limited to health, vision, dental, and other forms of insurance. The companies will have staff at the benefits fair to provide employees with information prior the city's open enrollment period. Every company at the benefits fair has a business or contractual relationship with the City of Kenner, as they provide benefits to city employees.
Some the companies have asked about providing door prizes and gifts to employees who attend the benefits fair. Only City of Kenner employees may attend and receive the gifts. All items would have company logo. The items include, but are not limited to promotional items such as beach towels, t-shirts, cups, etc. Prizes are going to be awarded by a random drawing and some of the smaller items such as pens and key chains will be available to anyone who stops by a vendor's table. No items are valued at over ten dollars.

Law:
Section 1115 of the Code of Ethics prohibits a public servant from soliciting or accepting any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person who has or who seeks a contractual, business or financial relationship with the agency of the public servant.
Section 1111A states that a public servant may not receive any thing of economic value, other than the compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

Section 1102(22)(a) defines "thing of economic value as money or any other thing having economic value except promotional items having no substantial resale value; food, drink or refreshment consumed by the public servant while the personal guest of some person.

Recommendations:
Adopt proposed advisory opinion
