Advisory opinion regarding whether the Mayor of Bossier City, Lorenz Walker, may use his campaign funds to purchase a fallen soldier monument.
Facts:
Mayor Walker states that he was recently re- elected without opposition for my third term as Mayor of Bossier City, Louisiana, effective July 1, 2013. Colonel Steve dePyssler, Director of the Retiree Activities Office at Barksdale Air Force Base and Judge Ted Cox have initiated a project to acquire and place a Fallen Soldier Monument inside the entrance to the Northwest Louisiana's Veteran's Cemetary in South Caddo Parish. The project budget estimate is $ 15,000. Judge Cox and Colonel dePyssler have requested that Mayor Walker use his campaign funds to make a donation of $15,000 to the Retiree Activities Office. The Retiree Activities Office is a 501 C(3) organization.
Law:
Section 1505.2I of the Campaign Finance Disclosure Act, provides that campaign funds may not be used for any personal use unrelated to the candidate's campaign or his holding of public office. Section 1505.2I also provides that surplus funds may be used for a future campaign, returned to contributors on a pro-rata basis, given as charitable contributions as provided in 26 USC 170 or contributions to 501C(3) organizations as defined in the IRS Code, or given as contributions to other candidates or political committees.
Recommendations:
Adopt the advisory opinion.
