Advisory opinion regarding whether the Superintendent of Caddo Parish School System, Paul Nelson, may hire the daughter of the Special Education Program Supervisor for the Parish School System as the Occupational Therapist for the Parish School System.
Facts:
Mr. Nelson states that at one time the parish employed an Occupational Therapist, but she passed away and for approximately 12 years the parish has been contracting services. The parish is paying an agency in Natchez, Mississippi a substantial amount of money to provide related services (occupational and physical therapy) and they are not always available to meet the obligations that are faced such as attending all IEP meetings and serving homebound students. Donna Tarver is the potential employee.

Ms. Tarver's mother serves as the supervisor for the Special Education Program. The Occupational therapist would be employed under the supervision of the Special Education program. As superintendent, Mr. Nelson hires all school employees. Ms. Tarver is licensed and certified. The recommendation for employment of personnel comes from the superintendent, The employee will be housed at a school site. The employee will be evaluated by a principal at the site where the assignment is made, and the salary will be determined by the Concordia Parish salary schedule.

Law:
La. R.S. 42:1119 of the Code prohibits the immediate family of an agency head from being employed within the agency of the agency head.
Recommendations:
Adopt the advisory opinion.
