Comments:
Ms. Pickering filed this waiver request 3 days late. However, it appears at the time the notice of delinquency was received on February 1, 2012, Ms. Pickering was dealing with ailing family members. On February 5, 2012, Ms. Pickering was out of town dealing with her father, who suffered a stroke while on vacation. While her father was undergoing a heart procedure, on February 10, 2012, Ms. Pickering's 12 year old daughter called from the motel to inform her that her husband had fallen and broken his leg.

At the hospital, it was determine he fell as a result of a dizzy spell caused by a heart condition. On February 13, 2012, he was released to be transfered to Lake Charles Memorial Hospital. On February 15, 2013, her husband fell again at home almost severing his right foot and were not able to operate until March 5, 2012. He was confined to a wheelchair for an additional 8 weeks. He is still, presently, taking therapy.

Ms. Pickering states that she could not keep everything together with so many appointments and taking care of her daughter.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than fourteen (14) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Consider the waiver request. Based on the waiver guidelines, waive the late fee.
