Advisory opinion regarding whether Edward Parker may accept employment as a water plant operator at the Vivian Town Water/Sewer Plant while his wife, Ashley Parker, serves as the Town book keeper. |

Ashley Parker is the BookKeeper for the Town of Vivian. Ms. Parker does not have the authority to sign checks or contracts. Ms. Parker, as payroll clerk, does review all time cards. If there is a discrepancy, she reviews this with the City Clerk, who in turn reviews the discrepancy with the foreman before changes can be made.
Edward Parker is the husband of Ashley Parker. He would like to apply to become a Water Plant Operator for the Town Water/Sewer Plant. He would be supervised and his time card/time sheets would be appoved by the public works foreman/superintendent.

La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
