RE:
Request for an advisory opinion as to whether Ms. Donna Bertrand, the Acadia Parish Human Resource Director, may be appointed to the Personnel Committee of the Acadia Parish Police Jury.
Facts:
Ms. Bertrand is the Human Resource Director for the Acadia Parish Police Jury. On June 12, 2012, Ms. Bertrand was appointed to the Personnel Committee by the Acadia Parish Police Jury. The Personnel Committee covers matters relating to personnel policies and practices, compensation and benefits, labor relations, employee relations, staffing and organizational structure.
A vote is taken on such issues to determine if the issue should be brought to the full Police Jury Agenda. The committee is made up of three police jurors and Ms. Bertrand. Ms. Bertrand is not compensated for her service on the committee.

Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.

LA. R.S. 1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

Recommendations:
Decline to render an opinion.
