Advisory opinion request regarding the current or former state employees may provide services to companies that are regulated by DHH.
Facts:
Alice Roeling stats that she is a Licensed Addiction Counselor and Certified Counselor Supervisor. She states that she retired as Facility Manager for the Springs of Recovery Adolescent Program in 2008. She is currently employed as a WAE Program Assistant with the Office of Behavioral Health. Under the Addictive Disorders Regulatory Authority Licensed and Certified Counselor Supervisors are permitted to provide off-site supervision of Registered Addiction Counselors and Certified Addition Counselors. Ms. Roeling would like to know whether a former or current state employee may provide services or advice for pay for an employee of a private agency which is licensed by the Department of Health and Hospitals. She would also like to know whether or not the services may be provided uncompensated.
Law:
Section 1111C(1)(a) prohibits a public servant from receiving any thing of economic value from an outside source for the performance of services which are devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated. Section 1121 prohibits a public servant from contracting with her former agency to provide the same services she provided while a public employee and also prohibits her from assisting another person, for compensation, in a transaction involving her former agency in which she participated while a public employee, for a period of two years. Section 1111C(2)(d) prohibits a public servant from being employed by a person who has a business or financial relationship with the public servant' agency.
Recommendations:
Decline to render an advisory opinion.
