Untimely waiver request submitted by Jerry Gathings, a member of the West Carroll School Board, regarding a $200 late fee assessed for filing his 2010-2011 school board disclosure statement untimely. |

It appears that although the letter is correctly addressed, the address of the receipent of the late fee notice is different. Mr. Gathings contends he did not receive the late fee notice and therefore, could not timely request a waiver. He received a demand letter, which prompted his request for a waiver.
This is Mr. Gathings first late filing.

La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.
